USCIS sends out three copies of the approval notice Form I797 A: Sent to the attorney on record, Form I797 B sent to the Petitioner and Form I797C sent to the beneficiary. Check the lower right hand corner of the notice you received for the form number. The B and C versions are courtesy copies. That is why if you look at the "documents needed" section for stamping of H1B in any of the Consulates or VFS sites they typically mention "original Form I797A"

Medical records are initial evidence. what it means is, that you must submit the medical records with the 485.
If you can attach some report from doc saying that it is curable or is of less percentage and blah blah blah .... as said earlier you can send in the clear report later.

I think i tried everything to get my I-485 approval. But nothing worked.
1. So far 3 SRs have been created. No response.
2. Infopass - No response (other than pending status)
3. Letter to Ombudsman - No response so far. Its been more than 50 days.
4. Called IO's several times - Nothing happend.
5. One IO told me that she would try to assign my file to an officer. This was two months back. Nothing happend.
My case is still waiting to be assigned to an officer. What else should i do?
MY case details are PD:02/2002, EB2, India. I-485 RD: 06/06/07.

Too early for this thread. Only you could see NO. Is there anyway to create a poll to change from No to YES when the checks are cleared. Then this will be useful, otherwise it is going to be a waste thread in next two days.

No, you don't have to be employed while in EAD but do remember GC is future job, if have something to show them then you are safe.

If you do not expect these two events while you are waiting for I-485 approval, there is no need to work.

Does she have EAD? If not on H1, she needs to be in EAD. (or other status like F1 etc). Otherwise she is out of status. In that case, H1 will be denied because an H1 application while out of status will lead to denial.

Seems right to me... I think a lot of 2004-2005 applicants are also getting approved.
BTW, I am also a 2006 applicant and July 2nd filer but still waiting... :(

I have the same issue...my original DOB is different from whats in all my offical documents....local muncipality in India had my birth certficate with original DOB...I said we dont have birth certificate at all...so, they issued me certificate of non-availability....this should be easy to get....
if you submit the original one with different DOB than whats in the passport, it will screw up the whole thing.....

Hi all,
My job duties are in fact the same and there is no change. My compay lawyer had incorrectly filed as EB3 as my initial job position said bachelors plus 2 years of work experience. I had five years of experience before joining this company.

they told me that there would not be a 10% penalty but I cannot roll over either. My basic question is that whether IRS controls the benefits offered by private organization based on visa status ? This does not make sense.
Retirement benefits are similar to health benefits, tuition reimbursement benefits etc., in that the employer can choose whether to offer them or not. Why would visa status come in picture ? Also, L 1 is 'dual intent' and my I-485 was applied on June 28, 2007.
Could someone comment on the legality of this whole argument ? Thanks a lot.

Is corp to corp a better option or should i ask my other XYZ company to file for my H1B?
Okay..Here is the deal..If you are on H1B currently and do NOT have any paystubs for longer than a month (usually), then you face the risk of getting an RFE from USCIS regarding your status.
This is YMMV meaning you may get it or you may not, nobody can say for sure...It all depends on how closely USCIS looks at your case.
If you have been on H1B status without paystubs longer than 183 calendar days, you have bigger problems. My recommendation in that case is to get a good attorney ASAP.
If you feel your case status so far does not have any major legal or immigration issues, my suggestion is to use the EAD to work and make sure you renew it on time and stay in AOS. The downside to that is if your spouse's 485 has any issues and gets denied, then you are immediately out of status. (If that happens, you probably have more to worry about than just your status)
As always, take the above with a pinch of salt and consult an attorney in moments of doubt...!
