sorry to hear about your denial.
Regarding my friend, His 140 was denied but he was already on EAD by then.His 485 was not denied ( maybe they were not processing his 485 at that point.He is a july 07 filer under EB3-I). The appeal for 140 denial was filed and it is still pending(8 months now). Meanwhile a 2 yr EAD has been approved.
I am not sure if this process is followed for everyone as each case has its variables.....

Hey all,
Saw August Visa Bulletin on Mid July.
Checked the appointments PDF in chennai consulate and did not see appointments for August yet.
Sent an email to Chennai consulate requesting when will my appointment be as per the new august bulletin and surprisingly they sent a reply saying that I was scheduled for August 11nth.
Started preparing for the interview. Told my employer and client that I am leaving to India for the interview.
Got the notarized copy of the employment letter.
Started on July24th and reached July25th night.
Got some sleep and went to local police station and applied for the PCC but the local police station asked too many question and gave me hard time.
Went to Lister Laboratory and took the medicals.
Went to local police station for atleast 10 times between saturday and Sunday following up but no proper answers
Got the results from Listor laboratory and went to the Doctor and got the medical report done.
Got frustrated and went to commissioners office on Monday and came to know that there is a official PCC format request in that office and applied for the same immediately.
Personally met ACP and explained the situation and he promised me to get the PCC the very next day.
went directly from the commisioner office to Passport office and applied for the PCC there too since the US consulate in chennai requested the PCC to be given form both passport office and the commissioners office.
Tuesday Morning got police verification for me and my wife in our homes.
Tuesday evening went to passport office and collected the PCC stamped in the passports and collected the PCC from them.
Went to Commissioners office and collected the PCC from there too.
Wednesday executed the secondary BCC affidavit since my name was not written on the BCC.
Wednesday took all the documents and went to local VFS office and submitted all the documents and paid courier fees.
Went to US Consulate on August 11th Morning around 7.30 AM.
We were let inside and asked to wait in the waiting room for couple hours now.
We were called around 10.00 AM and an Indian lady verified all the documents and asked for all the originals.
The original documents requested are BCC, PCC, Offer letter, Affidavit, Marriage photos, marriage invitation,.....
We told the officer that we have an infant and asked if it will take more time. The officer promised to call as first.
10.45 AM they called us around 10.45 and took finger printing for me and my wife.
11.15 AM an American lady officer called us and asked some questions like how long I have been in US, whom do I work for, whats my designation, and asked couple question to my wife.
Finally congratulated us and said they are issuing the immigration visa to us and that we will get our passports in a week and handed over all the original documents back to us.
Started from the consulate.
Started to US on last Thursday.
Reached on Thursday here at LAX port of entry.
Asked to wait for an hour.
took finger printing and asked us to get our baggage and waited in the waiting area.
One hour from there one officer called and said the passports are stamped and we are all set to go.

I really don't know...when i look at processing times...TSC done application until Feb 15th...last month it had Jan 29th...just moved 16 days...i don't know...i did e-filed may 9th...
I think the interim EAD is no longer available. But you might get your EAD before Aug 16th. I got my EAD in 45 days (paper file at NE)

I used to work for big4 in IT, they file in EB3 unless you're a Sr. Mgr. I quit and joined another US company just for EB2...hoping for the best.

My application reached NSC (as per FedEx tracking) on July 24.
My co-workers who filed to NSC thru' same lawyer all got receipts and FP notices. Many of them filed weeks after.
My checks have NOT been encashed yet. Neither I have received any updates on receipts or any kind of processing.
USCIS offers no help and told me to wait for 90 days. Lawyer has the same opinion. Last USCIS receipting update shows that all centers have processed upto July 29 applications.

Nope, you are not an illegal as their reply on your application will show the date as 7th December, which is not your fault.

The denial letter will mention the deadline for you to leave this country. Usually it is 30 days.

Yes. He should send the appeal within the time frame of 30 days. No there is no premium processing.

The USCIS did not mentioned any reason like my valid labour is expired.Not sure is the denial is because of 180 day rule or not.
Here is the reason...
The petitioner did not submit an individual labour certification for the beneficiary or evidence of schedule A designation.As such, the beneficiary is ineligible for classification as a member of the preofessions holding an advanced degree or an alien of exceptional ability.

While the thread was started on a light note, I think this is a serious topic.
Most of the people in the developed (and increasingly in the developing) countries are over-weight. I believe people are over weight, because they are not eating good food. People just follow the latest fad (in India this is oatmeal, soybeans etc. for now).
I have successfully managed my weight below 24 BMI for almost a decade now by eating good food. The key is "moderation" and eat unprocessed food as much as possible.
If you have to choose between whole milk and fat free milk, choose whole milk. If you have to choose between red rice and white rice, choose red rice. If you drink, do not drink the cheapest variety. Go for Blue label or Hennessey and drink just a peg a week. Go and eat the most expensive cut of beef and eat just an ounce of it. And for the record, I haven't found anything wrong with traditional breakfast (uppuma, puttu, dosa and what not). If you like the taste of oatmeal go for it, but once in a while.
And do not forget to do some exercise everyday. 30-40 minutes of walk, bicycling, swimming, playing some games; any thing will do.

I wanted to post this because like you I also want other readers to be aware of what other people think of Senior Members. I don�t share your sentiments where you say Senior Members have heckled people (I am also a Junior Member). In fact they have been more then helping.

To me he is giving the obvious answer, which anyone following the forums should have known already. Straight I 485, EAD and AP filing, then aim for 6 months.
Let us form a group who are pushing to introduce Ammendment for Filling I485, AP &EAD when I140 approved/pending for 6 months, eventhough Cut-off dates are not reached for EB category immigration. I am in same position you are in..i have applied for an extension for my mother in law for another 6 months ...it's been 5 months still waiting for approval...but i took a chance and made my mothe in-law stay back based on pending approval...its your call how bad you need your monther in-law's help during your daughter's treatment..if possible take the letter form doctors office that your daughter is sick and you need her help in this hard times and attach this letter with you extension application.. this will help for extension..this is what i did..

It's impossible, atleast for me. I can't even think that I won't be able to go to India for 5 years. It would be a torture on my soul. This kind of clause works for an un-documented immigrant, who don't have a choice to leave but not for legal immigrant.
What my company tell me to go to another country say some Brazil to implement project and infrastructure and I had to stay 2 months? Then I have to start afresh ?

I applied for my green card almost six years back (EB3 Jan 2003) and working with the same employer for more than 7 years on H1B. My 140 was approved in 2007 September. Recently I got a new job with pretty similar title and job descripiton. The job is in a different state . Here is my question...
Is it better to use my EAD (which is valid until October 2010) or do a H1B transfer? In case my current employer withdraw the 140 application ,whether that cause any issues?
Do I need to go back to my current employer once I get my green card?
Is it possible to go back to H1B once I start using EAD?
